Terms of Service

These terms govern how you use BuildSpain. They're written in plain English where possible — if anything is unclear, email us at info@buildinspain.com and we'll explain.

1. Acceptance of these terms

By creating an account, posting a lead, applying as a builder or otherwise using buildinspain.com (the “Service”), you agree to these Terms. If you don't agree, please don't use the Service.

2. Who we are

BuildSpain (“we”, “us”) is an online marketplace connecting British and English-speaking property owners in Spain with vetted local builders. We operate the platform; we do not perform construction work ourselves and we are not party to any contract you sign with a builder.

3. Accounts

You need an account to post leads, message builders, or list a builder profile. You're responsible for keeping your password safe and for everything that happens on your account. Tell us immediately at info@buildinspain.com if you suspect any unauthorised access.

Accounts must be created by humans, with accurate information. We may suspend accounts that contain false details, are used for fraud, or violate these Terms.

4. Owner responsibilities

If you post a lead as a property owner, you confirm that:

  • The project you describe is real and you intend to actually carry it out.
  • You own the property (or have written permission from the owner).
  • You will respond in good faith to builders who reach out, even if it's only to say “no thanks”.
  • You won't use BuildSpain to harass or spam builders.

5. Builder responsibilities

If you apply as a builder, you agree to:

  • Provide accurate information about your business, registration and references during vetting.
  • Quote in writing and in English, with line items, before starting any project.
  • Handle permits and end-of-project paperwork (licencia de obra, boletín eléctrico where relevant).
  • Carry valid liability insurance appropriate to your trade.
  • Respond to leads in your region in good faith.
  • Not contact owners outside of BuildSpain to circumvent platform fees once a lead has been delivered through us.

6. Membership fees and cancellation (builders)

Approved builders pay a flat membership fee of €55 per month after a 5-day free trial. The trial requires no card; if you don't add a card before it ends, your profile simply goes inactive and no charge is made.

Membership renews monthly. You can cancel any time from your dashboard — cancellation takes effect at the end of the current billing period. No partial refunds for unused days.

Payments are processed by Stripe. We don't store your card details.

7. Vetting limitations

We check business registration, references and English fluency before approving a builder. We do not guarantee work quality, project timelines, pricing, or the outcome of any specific project. Builders are independent contractors, not our employees or agents.

Always agree on a written contract, fixed price, payment schedule and completion dates directly with the builder before work starts. Read the contract before signing.

8. Disputes between owners and builders

If something goes wrong on a project — a builder doesn't finish, a payment is disputed, quality is poor — we'll do our best to help both sides talk. We can suspend a builder's profile while we investigate, and we keep records of all in-platform messages for evidence.

Final resolution of contract disputes is between you and the builder, typically through Spanish small-claims courts (juzgado de primera instancia) or whatever forum your written contract specifies. BuildSpain is not a party to that contract and cannot be obliged to refund construction payments.

9. Intellectual property

The BuildSpain name, logo and platform code are ours. Photos you upload to your builder profile remain yours, but you grant us a non-exclusive licence to display them on the platform and in related marketing materials while your account is active.

10. Termination

You can delete your account any time from your dashboard. We can suspend or terminate accounts that violate these Terms, particularly in cases of fraud, harassment, or attempts to circumvent the platform fee. We'll explain the reason in writing.

11. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising from your use of the Service is capped at the total membership fees you've paid in the 12 months immediately preceding the claim. We're not liable for indirect or consequential losses (lost profits, lost goodwill, lost data).

12. Governing law

These Terms are governed by the laws of England and Wales. Any dispute between you and BuildSpain that cannot be resolved informally goes to the courts of England and Wales.

13. Changes to these Terms

We may update these Terms over time. Material changes will be flagged on this page with an updated “last updated” date, and we'll email registered users with a summary. Continued use of the Service after changes means you accept them.
